The Basic Court dismisses the indictment against Klodian Allajbeu, Ekrem Lluka and others

The Supreme Court of Pristina has dismissed the indictment of the Special Prosecution against the owner of the American Hospital, Klodian Allajbeu, the owner of the Kosovo Cardiology Center, Ekrem Lluka and others for forgery of documents and distribution of money.

The court has found that the indictment filed against them does not include sufficient evidence that serious crimes were committed.

“The documents considered forged were signed by an authorized person and there was no intervention to fulfill the elements of the criminal offense of forgery under Article 390 of the Criminal Code. The act of providing evidence cannot exist after a previous proven criminal offense. The prosecution has incorrectly applied the 2019 Criminal Code to an alleged criminal offense committed in 2014-2015, when the Code was in force. From 2012, which has more favorable provisions,” the court’s findings state.
