Only one indictment for the manipulation of the December 28, 2025 votes

For the manipulations in the vote counting in the elections of December 28, 2025, only one indictment has been filed against 4 people so far.

From the data published by the 7 basic prosecutors' offices, it appears that at least 700 people have been interviewed regarding suspicions of manipulation of candidates' votes during the counting. 

This figure does not include announcements of investigations and interviews where the number of suspects is not mentioned. 

All of them are likely to be involved in the vote counting again, as the Central Election Commission has not yet made a decision regarding the prohibition of persons under investigation from engaging as commissioners. 

The only indictment for stealing votes from candidates in the December 28 elections was filed by the Ferizaj Prosecution Office in March. 

However, he did not share information about whether there are other people under suspicion.

"In March 2026, this Prosecutor's Office filed an indictment against four (4) defendants, due to well-founded suspicion of the criminal offense of "Falsification of voting results" under the Criminal Code of the Republic of Kosovo. The Basic Prosecutor's Office in Ferizaj remains committed to protecting the free vote of citizens, and will investigate every suspected case, in order to preserve the integrity of the electoral process and the rule of law," the announcement of the Basic Prosecutor's Office in Ferizaj, in March 2026, states. 
According to a report by Democracy in Action, during the counting process, approximately 250 votes of candidates for deputies in the last parliamentary elections were manipulated. The manipulation of votes was confirmed by the CEC itself, after a full recount of those for candidates.

The largest frauds are suspected to have occurred in Prizren, where nearly 70 votes were tampered with. 

On January 23, the Basic Prosecution Office of Prizren interviewed 109 people on suspicion of fraud at the Municipal Counting Center.

Later, the Prosecutor's Office interviewed nearly 100 other commissioners from the municipalities of Dragash, Suhareka and Mamusha. 

A large number of them were even sent to detention, but were later released. 

But no indictment has yet been filed for these suspicions of manipulation, and the Prizren Basic Prosecution Office has not indicated how many people are suspects or whether any indictments are expected to be filed.

"Investigations regarding this case are still ongoing and any additional information at this stage may compromise the integrity of the investigative procedure. The Basic Prosecution Office in Prizren, in accordance with the legal provisions in force, cannot provide information or comment on matters that are currently under investigation. This restriction aims to guarantee the impartial and orderly development of the procedure, as well as to avoid any possible impact on the progress of the investigations," the response of the Basic Prosecution Office in Prizren states.

The Prosecution Office in Mitrovica has said that the cases are in the investigation phase, but has not shared more information on whether there will be indictments and, if so, when. 

In early February, the Prosecutor's Office invited 43 people for interviews, and requested detention for 10 of them. 

The Gjakova Prosecutor's Office has also said that the cases are under investigation, but they have not shared any more information. 

In the municipalities under the jurisdiction of this prosecutor's office, public data shows that nearly 100 people were interviewed, mainly commissioners from Malisheva and Gjakova. 

The Peja Prosecutor's Office also said that the cases are being investigated. Public records show that this prosecutor's office has investigated nearly 200 people as suspects of vote theft.

"Regarding the questions posed, we inform you that the Basic Prosecution Office in Peja, Department of Serious Crimes, has received dozens of criminal reports against election commissions and chairmen for the process of counting the votes of candidates of political entities. We are currently in the investigation phase against hundreds of suspects," the response of the Basic Prosecution Office in Peja states.  

The Basic Prosecution Office of Pristina and Gjilan have not responded to KOHA's questions regarding this matter.

CEC members have said that they intend to establish a criterion for the certification of commissioners that they are not being investigated for electoral violations. However, no such decision was made at the meeting held last week.
