The Basic Prosecution Office in Prizren, Serious Crimes Department, has filed an indictment against the defendant BP, and the legal entity “B. Sh.PK”, due to well-founded suspicion that they have committed the criminal offense “Misuse and fraud in public procurement” under Article 415 paragraph 2 of the Criminal Code of the Republic of Kosovo.
According to the indictment, dated 22.12.2023 in Dragash, the defendant BP, in the capacity of the authorized person of the economic operator "B. Sh.PK", is suspected of having intentionally violated the public procurement rules by not implementing the obligations arising from the public contract entitled "Supply with sixteen pieces of photocopiers for schools in the Municipality of Dragash".
As the Prosecutor's Office reports, during the implementation of the contract, instead of delivering 16 new photocopying machines, as foreseen in the contract, 16 re-manufactured machines were delivered, namely old, serviced machines in which new consumables were installed.
"With these actions, the Municipality of Dragash has been caused economic and budgetary damage, as the re-manufactured equipment has a lower durability, requires more maintenance and may create additional costs compared to new equipment. The Prosecution has also filed an indictment against the legal entity "B. Sh.PK", as the economic operator who won the aforementioned contract, for the same criminal offense," the announcement states.
The prosecutor of the case, upon filing the indictment, proposed to the court that after holding the judicial hearing, administering the evidence and evaluating it, the aforementioned defendants be found guilty of the criminal offense for which they are accused and be sentenced according to the law.
