Arben Xhaferi, in his analyses, described the difficulties and approach of Macedonian politicians as an anti-Albanian mentality that never ceases, especially in the face of the rights that Albanians in North Macedonia gained from the Ohrid Agreement.
He warned that: if the Constitution grants Albanians certain rights, they will be hindered by laws; if these rights are gained by laws, they will be curtailed and minimized administratively. This warning of Arben Xhaferi is becoming a reality today in an administrative premise through the non-implementation of rights stemming from the Ohrid Agreement, such as adequate representation, the official use of the Albanian language and participation in decision-making in the government of North Macedonia, which is currently perceived as one-party and one-ethnic.
The Constitutional Court of North Macedonia should preserve the spirit of the Ohrid Agreement and the interethnic cohesion of the state, and not follow Macedonian nationalist party frustrations. Such an approach could push North Macedonian Albanians to organize to the level of civil disobedience as a form of defensive reaction.
Albanian judges on the Constitutional Court should not play the role of notary of the destructive actions of Macedonian judges, but should be there to raise their voices and defend constitutional principles, not to play the role of statistician.
They must react through non-participation or even resignation, if this institution continues with this approach that is perceived as anti-Albanian.
