Spanca: We have sent 80 suspicious cases to the Prosecutor's Office, three indictments have been filed

The National Audit Office (NAO) has sent 80 suspicious cases to the Prosecutor's Office during 2025.

Of these cases, Auditor General Vlora Spanca announced that three indictments have been filed. During the discussion in the Public Finance Oversight Committee, she emphasized that these cases were initiated by 133 audits published by the institution she leads.

In addition to these cases, she also spoke about single-source contracts, which were discussed between deputies from the Democratic Party of Kosovo and the Vetëvendosje Movement.

The Auditor General of the National Audit Office, Vlora Spanca, spoke about the number of audit reports during the past year.

"For the year 2025, we have published 133 audit reports, 104 audit reports are financial and compliance audits. There are 14 performance audits, 12 compliance audits, audits at the level of classified information - the classified level that we have audited is only the limited level and these reports are not made public but are only sent to the Assembly of Kosovo and to your respective committee. For all these audit reports for the year 2025, we have sent 80 cases to the State Prosecutor based on an agreement that we have with the State Prosecutor that we signed in 2023," she said.

Of these cases that have been sent to the Prosecutor's Office, Spanca said that only three indictments have been filed.

Spanca said that for such cases that have been sent to the Prosecutor's Office, institutions in Albania file indictments.

"As for whether we send cases that are not well-argued. That can also stand. We have addressed this issue by hiring more legal officers, we have four legal officers who are a little more active in this aspect and we review each case. But I was just mentioning if we compare it with Albania, for the same cases the Prosecution there, or SPAK files indictments for example for cases when a construction permit is issued without construction conditions, or not in compliance with construction conditions. We have had such cases and we have published the report for the Municipality of Pristina, then there was the report for the Municipality of Lipjan, now we are for construction permits in the Municipality of Ferizaj. But we have not had any progress in this aspect", replied Spanca.

Mustafa also raised the issue, which he considers to be concerning, of contracts without tenders for economic operators.

"We have a growing phenomenon that is very worrying where contracts are awarded to economic operators without tenders, without transparency and without justification as to why a contract should be awarded without tenders to someone, where there may be many economic operators in the market offering those services," he added.

Regarding contracts negotiated without a public hearing, the auditor general said that they are part of every audit.

"These contracts are audited in each budget organization due to the risk they carry, meaning insufficient transparency, which is part of each audit. And the issues that have resulted from these contracts, let's not forget that the contract as such is legal in circumstances when the cases are urgent. In circumstances that were not urgent and were not grounded, these cases are reflected in audit reports, but even in the annual audit report, the designation is the wrong procurement procedure that was used, it should not have been negotiated, but it should have been done with an open procedure," she said.

Auditor General Vlora Spanca also spoke to the committee about the January 2025 decision of the Ministry of Internal Affairs to locate this institution in a public building. However, she said that there is no information yet, adding that steps should be taken in this direction as soon as possible due to "security, insufficient space and the violation of the credibility of the NAO".
