The Prosecutor's Office at the Court of First Instance of General Jurisdiction, Tirana, completed the investigations and sent to trial five people, citizens F.Ç., AV, E.Xh., AS and AL, for the criminal offenses of 'Computer Fraud' and 'Infringement of Industrial Property Rights' provided for by articles 143/b pg.1 and 149 pg.1 of the Criminal Code.
In the framework of the investigations on criminal proceedings no. 6847, of 2023, initiated after the report of the company Digitalb, that various entities in Tirana and other cities of Albania, sell television packages to individuals through piracy, the Prosecutor's Office at the Court of First Instance of General Jurisdiction, Tirana, in cooperation with the Section against Economic Crime at the Tirana Local Police Directorate, proved that these persons, through their companies, deceived citizens as if they had the television rights to these channels.
These individuals, as administrators of their entities, enabled decoding and transmission through decoders. In this way, they generated income by violating the legitimate interests of the television companies that produce the programs and are the owners of the television rights.
Specifically, the Prosecutor's Office at the Court of First Instance of General Jurisdiction, Tirana, through simulated actions of purchases of equipment (decoders) and television packages that these entities traded by advertising on social networks and sold for values from 3500 to 10.000 lek, created reasonable suspicions based on evidence that the entities in question are responsible for committing the criminal offenses of "Computer fraud" and "Violation of industrial property rights", provided for by articles 143/b and 149/a of the Criminal Code.
The investigation revealed that the person under investigation, FB, was selling the packages by communicating on the WhatsApp application and offering the package for 79 euros, an amount he received in cash.
Meanwhile, citizen AV, using private mail, sold the packages for a payment of 3500 lek, payment which was made in hand with a list of channels provided by the 'Unik Shop' website, which included Albanian and foreign channels "BBV 1", "BBV 2", "Top Channel", "TV Klan", Digitalb, Tring, Sky, etc. television packages, which continue to be active from the date of payment.
Likewise, the subject Elektronika Shop, operated on social networks under the trade name “Elektronikashop.al”, owned by citizen E.Xh., and sold packages worth 4000 lekë and the device came via private post couriers. As well as the subject 4k server (Kanale.al), from the administered data it turns out to be in use/owned by citizen A.Sh., it offered it against payment of 100 Euros for 2 purchases. The channels are displayed via IboPlayer. Part of the investigation was also the subject AK, under the name “Lila Shop” selling them via social networks “lila_shop_elektronik_al” for 6500 lekë and the decoder device came via private post couriers.
The investigations proved that citizens F.Ç., AV, E.Xh., AS and AL, fulfill the elements of the criminal offenses provided for by Article 143/b, first paragraph, and Article 149/a, first paragraph, of the Criminal Code, namely computer fraud and violation of industrial property rights, and are being prosecuted for these criminal offenses.
