There are still eight days left until the deadline set by the Constitutional Court for a temporary measure, as after 54 attempts, the Assembly has not been constituted. This political impasse continues to block many institutions in the country in terms of budget, as is the case with RTK, but also in terms of completing the boards, but not only that.
The failure to constitute the ninth legislature of the Assembly of Kosovo has begun to show its consequences. In the absence of the Assembly and the Government, many institutions are functioning without boards, and some are even dysfunctional.
The Kosovo Law Institute has identified 17 institutions whose work is being carried out with difficulty, and some have been completely blocked and their work has been suspended. Gzim Shala from this institute says that in this way the institutions are accumulating many issues to deal with, causing problems even for the new members who are elected.
"Even at the moment of constitution, it is not a procedure for many institutions, it is not a procedure that simply makes a decision on the same day, there must also be a competition, there must be a recruitment procedure, etc. etc., until the moment when the members of these bodies are selected and it should be emphasized that beyond the delay, the problem also lies in the previous legislature, because even at that time there were a number of open positions that were not filled and that today the negative effects only escalate further", said Shala.
Meanwhile, Vullnet Bugaqku from the Democratic Institute of Kosovo says that under these conditions, most institutions function inadequately, as they ultimately have a legal obligation to report to the Assembly on financial reports.
"This could lead to a situation where there could be arbitrariness in decision-making because many unresolved positions, many decision-making are both uncontrolled and unsupervised by the Kosovo Assembly and could easily be a source of misuse and abuse of duties, whether by independent institutions, agencies or individuals who, as a result of not electing directors or members of certain boards, could issue decisions that are not in compliance with the law," said Bugaqku.
According to the KLI, the list of blocked institutions is headed by the Constitutional Court with a lack of judges, the Procurement Review Body, the Ombudsman, the Independent Supervisory Council for the Kosovo Civil Service, the Kosovo Property Agency, the Kosovo Pension Savings Fund, the Regulatory Authority for Electronic and Postal Communications, the Independent Media Commission, the Independent Competition Authority, the Railways Regulatory Authority, the Environmental Protection Advisory Board, the Review Commission of the Water Services Regulatory Authority, the Board of the Public Enterprise KOSTT, the State Aid Commission, the Independent Commission for Mines and Minerals, the Public Procurement Regulatory Commission and the Appeals Board at the IMC.
Meanwhile, according to the KLI, the mandate of the People's Advocate, six members of the AKP and 15 members of the National Science Council will end this year./RTK
