“Joint Criminal Enterprise” – The Serbian Secret Service and its instruments

After the overthrow of Slobodan Milosevic from power, the new Belgrade government continued with the same propaganda. In November 2001, a new version of the old propaganda was published and distributed: "Victims of Albanian terrorism in Kosovo and Metohija (Ubijena, oteta i nestala lica, January 1998 - November 2001) [“Victims of Albanian terrorism in Kosovo and Dukagjin (murdered, kidnapped and missing persons, January 1998-November 2001)].

According to public statements by Vladimir Božović (Božović), an official in the Serbian Ministry of Internal Affairs and head of the Jurisprudence Directorate at the Coordination Center led by Nebojša Čović (Nebojša Čović), "His directorate and team of experts had worked from 2001 to 2002 to prepare materials on human organ trafficking in Kosovo.". “The collected materials were systematized on diskettes with 27 thousand pages on the crimes of the KLA commanders and were handed over to the investigators of The Hague” and “Clint Williamson, who was Head of the UNMIK Department of Justice and Human Rights in the period 2001-2002, and in the period 1994-2001 he worked as a prosecutor at the International Criminal Tribunal for the former Yugoslavia.

Based on the first files submitted during the period 2001-2002, Carla Del Ponte filed indictments against Fatmir Limaj, Haradin Balaj and Isak Musliu.

In the first version of the indictment, dated January 24, 2003, and in the second version of the indictment, dated March 7, 2003, we have the application of the Copy/Past technique of the “evidence” submitted by people from the Ministry of Internal Affairs of the remaining Yugoslavia. However, in September 2003, the “new” regime in Belgrade published a new version of the “white paper”, amended in accordance with the changing circumstances on the international political scene. At a press conference held in the Serbian Parliament, the Prime Minister of Serbia, Zoran Živković, the Deputy Prime Minister and Head of the so-called “Coordination Center for Southern Serbia and Kosovo and Dukagjin…”, Nebojša Čović, and the Head of the Serbian Secret Service, Miša Milićević, presented the book entitled "Albanian terrorism and organized crime in Kosovo and Metohija" (Albanian terrorism and organized crime in Kosovo and Dukagjin).

After praising the work of the Serbian Secret Service, the Serbian Prime Minister stated:

"The purpose of publishing this book is to assist those who must act against organized crime, first and foremost UNMIK and KFOR (…). It has been rumored that there is allegedly not enough evidence to take such actions, that they lack concrete facts, and so on. The book 'Albanian terrorism and organized crime in Kosovo and Dukagjin' provides many explanations and facts about the crimes committed in Kosovo and Dukagjin. This book contains a lot of data about the structure of the terrorist organization of Albanian extremism, about the victims, about the activity of the Albanian mafia in the world; about the identity of terrorists and organized criminal structures in Kosovo; about the political leaders of Kosovo who were at the same time also leaders of criminal clans; for trafficking in human organs from imprisoned Serbs and plenty of explanations and facts about the crimes committed in Kosovo, which could also be quite interesting for the work of the Court in The Hague.. "

In addition to the KLA's connection with "terrorism" and "Islamic fundamentalism", in the 2003 edition, Serbia attempts, as never before, to criminalize the aspirations of the Albanian people for freedom and independence. In the language of Serbian Secret Service agents  "developing a sense of collective identity among Albanians, especially those from Kosovo and Dukagjini, is a necessary condition for dealing with organized crimeIt is precisely this element, which is based on belonging to a certain group, has linked Albanian organized crime with political, military ideals and terrorism (…) Behind the ideological and national motives for the creation of a single Albanian state, regardless of whether it will be called 'Greater Albania' or 'Greater Kosovo', lie the interests of some criminal structures, which are trying to become part of existing political and economic processes to legalize their criminal activities (…).

After they were attributed to the Albanians global control of the drug trade, international prostitution, illegal trade in weapons, cigarettes and other excise goods, stolen cars, human trafficking and the sale of human organs (…), Serbian Secret Service agents come to the conclusion se"Kosovo society is not a society affected by organized crime, but a society based on organized crime!"

In full accordance with the "data" he had extracted from the Serbian propaganda book "Albanian terrorism and organized crime in Kosovo and Dukagjin”, where the KLA is described over 100 times as "organization that has a criminal project", Carla Del Ponte also changed the second version of the indictment and in the changed version, dozens of times she described the KLA as "Criminal Enterprise SIngle" that supposedly "has carried out general and systematic attacks directed against the Serbian civilian population and Albanians suspected of being collaborators against whom he has carried out torture, cruel treatment, murder...".

In the same spirit as that which prevailed in the indictment against Fatmir Limaj and his comrades-in-arms and based on fabricated material submitted by the representatives of Serbia, on March 4, 2005, Carla Del Ponte filed an indictment against Ramush Haradinaj, Lahi Brahimaj and Idriz Balaj.

In the first version of this indictment and in the four amended versions of the indictment, Carla Del Ponte applied the same Copy/Past technique of "evidence" fabricated by the Serbian Secret Service and of the KLA's descriptions as "Criminal Enterprise" "Together".

The same thing happened with the Kosovo Specialist Chambers. A month before the indictment was confirmed and the arrests were made Jakup Krasniqi, Hashim Thaçi, Kadri Veseli and Rexhep Selimi, Milovan Drecun was a guest on the show titled "The one-way 'journey' from Pristina to The Hague begins", on Happy TV. I remind readers that Milovan Drecun is a Serbian criminal against whom Association of Independent Journalists of Serbia filed a lawsuit with the War Crimes Court in Serbia for media manipulation in order to incite crimes in Kosovo. This "journalist" Radio Television of Serbia, decorated by the commander of the Third Yugoslav Army, which committed crimes in Kosovo, Colonel General Nebojša Pavković, was placed in charge of the Serbian Working Group that prepared evidence for the Kosovo Special Prosecutor's Office.

During the conversation with TH Happy journalists, Milovan Drecun, on behalf of the Serbian Working Group, speaks disparagingly about the team of prosecutors working with Chief Prosecutor Swendiman, who did not know the circumstances in which the events had occurred, did not know in which direction to conduct the investigations, and that the Serbian Working Group "It contributed a lot to giving them the right direction. For me, it was essential to show the prosecutors in which direction to develop the investigations, because I saw that they were wandering around, because they had grasped the problem too broadly."

He says he directed them towards the issue of Illegal Detention Centers because "It has been easier for them to witness crimes through these illegal centers. We have given them:

  • the full list of 159 detention centers that our services have identified, of which 6 were in northern Albania;
  • the names of those who created these centers,
  • people who have mistreated people, who have killed them, who have massacred them, raped them (we have many cases of raped women)..."

Imagine what a paradoxical situation we have come to: the criminal Milovan Drecun, who was directly involved in inciting crimes against Albanians in Kosovo and against whom Association of Independent Journalists of Serbia had filed an indictment, had determined for the Kosovo Special Prosecutor's Office in what direction it should conduct the investigations!

And about the work he has done, Milovan Drecun declares: “what"In the first phase, I received a thank you from Chief Prosecutor Swendiman. The thank you was even handwritten, which is unusual, because it is clear that we have helped them a lot to see in what direction the investigations should be developed."

Therefore, this is not a matter of hypotheses, but the truth of the fact that the indictment was built on fabrications by the Serbian secret services is publicly affirmed by the man to whom Chief Prosecutor Swendiman has given his gratitude!

The indictment against Thaçi, Kadri Veseli, Rexhep Selim and Jakup Krasniqi removed all illusions of false propaganda that a court would supposedly be established to "cleaned"  the history of the KLA war from suspicions of crimes and organ transplantation, accusations that hung over Kosovo like black clouds, or like a rope around the neck for many years." All those who have had the opportunity to read the public parts of the indictment in question have understood the deception: Not only were neither the black clouds nor the noose hanging around Kosovo's neck removed, but the Kosovo Special Prosecutor's Office erected the gallows - indictment and put the noose around the neck of the Albanian people's liberation war and aspirations for building an independent state. In a word: The indictment attempts to condemn the Kosovo liberation war to death.

I suggest to all those who wish to verify the accuracy of the above-mentioned opinion to read the indictment (the part that is public) and to be convinced of the influence of the Serbian Secret Service's agents in characterizing the KLA and tendentious interpretations of the events that occurred during the war in Kosovo. In this context, we see it appropriate to clarify for the readers three key categories of this indictment: "members of Joint Criminal Enterprise", "instruments of Joint Criminal Enterpriseand "opponents".

In the category "members of Joint Criminal Enterprise" includes members of the Kosovo Liberation Army and members of the Kosovo Provisional Government (KPK):

"Hashim Thaç, Kadri Veseli, Rexhep Selimi, Jakup Kasniqi, Azem Syla, Lahi Brahimaj, Fatmir Limaj, Sylejman Selimi, Rrustem Mustafa, Shukri Buja, Latif Gashi, Sabit Geci as well as several other political and military leaders of the KLA and the CPK- including other members of the General Staff; ministers and deputy ministers of the KPA; KLA zone commanders, deputy zone commanders and other members of the zone command staffs; brigade and unit commanders; commanders and members of the KLA and KPA police and intelligence services; and other KLA soldiers and other KPA officials. All of these individuals, by their actions and inactions, contributed to the achievement of the common goal.” (Specialized Chambers and Kosovo Specialist Prosecutor's Office. Case number: KSC-BC-2020-06, Annex 5 to the Amended Indictment and Related Documents § 33-35).

In the category "instruments of Joint Criminal Enterprise" includes those people who were not part of "Criminal Enterprise" t"The Common" but that “were used by members of the Joint Criminal Enterprise to commit crimes in furtherance of the common purpose” (Ibid., § 35).

While within the "opponents" category included persons who were, or who were considered to have been:

  • collaborators or affiliated with FRY state forces, officials or institutions, or 
  • persons who did not support the goals or methods of the KLA and later the CPK, including persons affiliated with the LDK and Serbs, Roma and persons of other nationalities (Ibid., § 32).

With the aim of securing and exercising control over the entire territory of Kosovo, the members and instruments e Criminal Enterprise SIngle have carried out widespread or systematic attacks against the civilian population of opponents in Kosovo and areas of Northern Albania, at least from March 1998 to September 1999 ('indictment period')" (Ibid., § 16-17 and 32), taking persecuted, imprisoned, arrested and detained arbitrarily or illegally and by carrying out other inhumane acts, cruel treatment, torture, murder and enforced disappearance of persons. (Ibid., § 32).

According to the indictment, the Kosovo Liberation Army and the Provisional Government of Kosovo are “Joint Criminal Enterprise” and not only is no KLA soldier or official of the Provisional Government of Kosovo excluded from this qualification, but the spectrum of suspects also extends to people who were not involved in the KLA and the KPC but who have served as an instrument for achieving the goals of the "Joint Criminal Enterprise"!

Anyone who reads the indictment carefully will be convinced that we are dealing with an attempt to condemn the liberation war of the Albanian people of Kosovo. Woe to those Albanians who, due to their personal hatred towards any of the above-mentioned defendants, are spreading the fabrications of the Serbian Secret Service and, consciously or unconsciously, have become instruments of this service.
