Acting Prime Minister Albin Kurti has said that they are awaiting the Constitutional Court's verdict on the issue of the constitution of the Assembly.
"We are waiting for the verdict," Kurti said briefly.
We recall that on September 30, 2025, the Constitutional Court issued a decision in which it found that the constitutive session had not been completed as a result of the failure to elect a deputy speaker from among the Serbian minorities. The deputies are obliged to complete the constitutive session within 12 days from the entry into force of this decision.
In the decision taken on September 30, 2025, the Constitutional Court declared admissible the request submitted by Igor Simiqi and nine other deputies, regarding the assessment of the constitutionality of the "Minutes of the Sessions of the Assembly of Kosovo", as well as the decisions issued within the framework of the Constitutive Session on August 26 and 28, 2025.
The Court's announcement states that the constitutive session has not been completed as a result of the failure to elect a deputy speaker from the ranks of the Serbian community, and the Assembly has not been constituted in accordance with the Constitution.
"TO STATE that the Constituent Session of the Assembly, which began on April 15, 2025, has not been concluded as a result of the failure to elect the Deputy Speaker of the Assembly from among the deputies of the Serbian community, and the Assembly has not been constituted in accordance with the provisions of paragraph 1 of Article 66 [Election and Mandate] and paragraphs 1 and 4 of Article 67 [Election of the Speaker and Deputy Speakers] of the Constitution of the Republic of Kosovo; TO ORDER that the Constituent Session of the Assembly be concluded within the time limit set by paragraph 1 of Article 66 [Election and Mandate] of the Constitution of the Republic of Kosovo and according to the Judgment of the Court in cases KO193/25 and KO196/25, respectively within the remaining time limit of 12 (twelve) days from the entry into force of this Judgment," the announcement states.
Likewise, the deputies are ordered that during the procedure for electing the Deputy Speaker of the Assembly from the Serbian minority, they exercise their constitutional function in the best interest of the Republic and in accordance with the Constitution and the Rules of Procedure of the Assembly.
"TO ORDER, all elected members of the Assembly of the Republic of Kosovo, in accordance with Article 4 [Form of Government and Separation of Powers], Article 7 [Values], paragraph 4 of Article 67 [Election of the President and Vice-Presidents] and Article 74 [Exercise of Function] of the Constitution of the Republic of Kosovo, that during the procedure for the election of the Vice-President of the Assembly of the Republic of Kosovo from among the members of the Serbian community, to exercise their constitutional function in the best interest of the Republic of Kosovo and in accordance with the Constitution and the Rules of Procedure of the Assembly," it further states.
The Constitutional Court has also decided to continue the interim measure until this judgment enters into force.
"TO CONTINUE, the interim measure, which entered into force on September 5, 2025, until the entry into force of this Judgment; TO NOTIFY this Judgment to the parties; TO PUBLISH this Judgment in the Official Gazette of the Republic of Kosovo, in accordance with paragraph 4 of Article 20 (Decisions) of Law No. 03/L-121 on the Constitutional Court of the Republic of Kosovo; TO DECLARE that this Judgment enters into force on the day of publication by the Constitutional Court of the Republic of Kosovo and notification of the parties, except for point V of the enacting clause, which enters into force immediately", announces the Constitutional Court.
