Rafa Mir, who is currently on loan at Elche from Sevilla, is under investigation following a sexual assault allegation made against him in September 2024.
He was arrested by the police at the time and, although he was released on bail, the case continues to be reviewed by the Prosecutor's Office.
Mir was on loan at Valencia at the time and was banned from the first team for three months after the allegations were made. He played 22 games for “Los Che” that season, and has scored seven goals in 23 appearances for Elche this season.
The issue has been in the works behind the scenes and now there are new developments.
According to "Las Provincias" (via "Cadena SER"), the Prosecutor's Office has requested that Mir receive a prison sentence of a total of 10.5 years.
They are seeking nine years for the charge of aggravated sexual assault with a carnal act and 18 months for the injuries suffered by the alleged victim.
Furthermore, the Prosecutor's Office has proposed that Mir cannot come closer than 500 meters from the victim for a period of 13 years, have seven years of supervised release and eight years of special prohibition on engaging in activities related to minors.
Mir, who denied the allegations during his arrest in 2024 and continues to maintain that the relationship with the alleged victim was consensual, has been embroiled in more controversy over the past seven days.
Omar El Hilali accused him of a racist comment during Sunday's match between Elche and Espanyol, and the matter has already been referred to La Liga.
