Lawyer Xhevdet Smakiqi, on the "Tempus" show on T7, said that a Prosecutorial Council that has integrity and independence does not have the President as its head.
"A Prosecutorial Council that has integrity and independence, first of all, does not have the President of Kosovo as its head, it is not allowed by the Constitution. The President of the Republic of Kosovo has only a formal competence, to approve the recommendation of the Council, whether for the election of the Chief Prosecutor or other prosecutors," said Smakiqi.
According to him, Kurti and Osmani did not reject the previous Council's recommendation for the name of the new Chief State Prosecutor.
"The cause was the political intervention of Albin Kurti and Vjosa Osmani, who in an unprecedented manner did not decree the recommendation of the former Prosecutorial Council for Blerim Isufaj, who had won the competition and based on the procedures that the Prosecutorial Council has," he said.
According to the lawyer, when we have direct political intervention from a Prime Minister and Government that labels prosecutors, then at this stage the competition for Chief State Prosecutor should be postponed and not announced in order for this new Council to show integrity and independence so that there are no political influences," he said.
