The Kosovo Assembly was declared constituted by Speaker Dimal Basha, although the process of electing all deputy speakers remained unfinished, without the election of the deputy speaker from the Serb community. The closing of the constitutive session under these circumstances has sparked discussions on the compliance of this decision with procedural rules and the Constitution.

In this regard, the Serbian MP in the Kosovo Assembly, Nenad Rašić, has stated to Front Online, questioning the legitimacy of declaring the Assembly as constituted. According to him, without a deputy speaker from the Serbian community, the Assembly cannot be considered constituted.

"I consider that it is not fully constituted, because it is normal that it lacks a vice president, and I had hoped that the process would be completed, but unfortunately it did not happen, but nevertheless without a vice president from the Serbian community, I consider that this is not a constitution," he said.

Rashic said he was surprised by the way the session ended on Saturday, when Speaker Basha declared the process complete. He said he does not see this as a fair approach and hopes to return to square one later.

"I was surprised at the end of the session on Saturday, where Basha declared that we are declaring the process complete. I do not consider this to be the right way and I hope that at some point we will return to point zero. There is no point in developing that further procedure regarding the determination of the constitution," he said.

 Rašić said that if no candidate from the Serb community receives enough votes, they will need the help of the Constitutional Court.

He said that the situation without the Serbian vice president is not fair.

"We need the help of the Constitutional Court, because in this regard, remaining as it is without the Serbian vice president is not the right way," he said.

Rashiqi says that it is expected that the Constitutional Court will act these days, perhaps even with a premature measure by the end of the week.

"The Constitutional Court will certainly react these days, perhaps by the end of the week, with a preliminary measure so that they can analyze it themselves and tell us what to do," he said.

Regarding his non-voting by the opposition, Rashic said that the deputies hesitated because they were convinced that such a vote could be unconstitutional.

He said that this was their main explanation and justification.

"Colleagues, deputies have hesitated because a belief was established that such a vote could be unconstitutional, and this is the explanation, the justification of all of them, in my personal case, even though they emphasized that it is nothing individual," said Rashiq.

He added that there is a bigger reason, and that is that many of them are locked into the strict positions of political parties.

"Consider that there is another reason, perhaps even more powerful than this, and that reasoning is that many of us have been barricaded in the positions of political parties that have lasted for several months, so every barricade, every change of mind in the party form, is being considered as weakness, which I absolutely disagree with," said Rashiq.

According to him, MPs must be willing to make clear decisions, without evasion or silence.

He emphasizes that the lack of voting is not a political stance, but a lack of courage to successfully complete the process.

"I consider that we as politicians, MPs in particular, must have the courage to make decisions for or against, without any abstentions or non-voting within parliament because, for me, this reflects differently not as a political stance, but perhaps as a lack of courage to establish a successful process," said Rashiqi.
