The trial of the defendant Luljeta Aliu, who is being charged with the criminal offense of unauthorized photography and recording of the injured party - lawyer Merita Stublla-Emini, failed to begin on Wednesday at the Basic Court in Pristina.

The judge in the case, Eroll Gashi, found that this Court had sent regular invitations to the accused and the injured party, but until the Court session was held, no responses had been received as to whether they had accepted the invitation in a regular manner, reports "Oath for Justice".

Only prosecutor Kushtrim Zeka was present at the hearing.

Judge Gashi announced that an indictment was filed against the defendant Aliu with a request for the imposition of a punitive order, but after reviewing the indictment, the Court returned it as a supplement due to the fact that this criminal offense provides for a sentence of 1 to 3 years, and that the Court cannot issue a judgment with a punitive order for this criminal offense.

Therefore, after specifying the indictment, the Court scheduled the initial hearing.

According to the indictment of the Basic Prosecution Office in Pristina filed on June 6, 2022, Luljeta Aliu-Krasniqi is accused of having, on July 27, 2020, in Pristina, while in the capacity of a debtor, in her statement submitted to the Office of the Private Bailiff, Rrezarta Memaj, claimed that she had recorded the conversation she had with lawyer Merita Stublla-Emini in her office and that she would present this evidence to the court, where the defendant subsequently submitted the same CD-audio-recording to the Kosovo Chamber of Advocates as evidence in the disciplinary procedure.

With this, it is said that the injured party Stublla-Emini was not aware of this action that was being recorded, but had an expectation of privacy in her office and consequently it was done without her approval. With this, it is said that the defendant has profoundly violated the injured party's privacy.

For this, the defendant Luljeta Aliu-Krasniqi is accused of having committed the criminal offense of "Unauthorized photography and recording" under Article 202, paragraph 2, in conjunction with paragraph 1 of the Criminal Code. /Oath for Justice/
