One sentenced to 2 years in prison and the other to 1, accused of calling to join the fight for jihad

The Basic Court in Pristina has announced a guilty verdict against Denis Bytyqi and Enis Bitiq, who are accused of inciting division and intolerance, after they called for joining the jihad through the social networks Facebook and TikTok. The defendant Denis was sentenced to 2 years in prison, while the defendant Enis was sentenced to 1 year in prison.

The verdict was announced on Monday by the presiding judge Violeta Namani-Hajra and members Lutfi Shala and Kushtrim Shyti, reports "Oath for Justice".

Judge Namani-Hajra said that Denis Bytyqi is sentenced to 2 years in prison, and Enis Bitiq to 1 year in prison for "Inciting discord and intolerance."

The detention measure of the accused Denis Bytyqi is terminated, on the grounds that the reasons for continuing this measure have ceased to exist.

The dissatisfied party has the right to appeal this decision within 30 days from the date of receipt of the decision in writing.

The judge emphasized that the phones used to commit the criminal offense will be confiscated.

The defendants were not present at the announcement.

Otherwise, the two defendants had pleaded not guilty at the initial hearing on October 9, 2025.

According to the indictment of the Special Prosecution of the Republic of Kosovo, filed on September 23, 2025, Denis Bytyqi and Enis Bitiq are accused of having publicly incited and spread hatred and intolerance between religious groups, as well as propagating extreme religious ideologies.

The indictment states that continuously until May 1, 2025, through their social networks "Facebook" and "Tik Tok", the defendants distributed posts with inciting content through which they called to join armed wars and the fight for jihad, as well as other posts where they expressed strong support for religious extremism and publicly supported the actions taken by the terrorist organization "ISIS", expressing deep hostility towards state institutions, security forces, political leaders, the United States of America and all those who do not share their ideology.

According to the indictment, they have placed flags of the terrorist organization "ISIS" on the roof of their house, have made graffiti in Arabic letters on the walls of their house, with which actions and posts could potentially disrupt public order.

With these actions, the accused are charged with having committed the criminal offense of "Inciting discord and intolerance" under Article 141, paragraph 1 of the Criminal Code, in conjunction with Article 31 of the Criminal Code.
