Analyst Halil Matoshi has reacted with harsh criticism towards the behavior of the Vetëvendosje Movement and its leader, Albin Kurti, following the publication of the latest verdict by the Constitutional Court of Kosovo.
In a lengthy analytical post, Matoshi accuses Kurti of “taking the state hostage” and acting in violation of the Constitutional Court’s decision. He emphasizes that Kurti is reading this ruling “not as an obligation to cooperate in good faith, but as an obligation of the opposition,” turning the crisis into a “constitutional coup.”
According to Matoshi, the Constitutional Court reinforced the 2014 judgment with a "dichotomous and often rigid and breathless language of sanctioning", where it was clearly established that:
"No to extraordinary elections, no to secret ballot and yes to political agreement", a verdict that, according to the analyst, "proves Albin Kurti's bluff", he writes.
He mentions four main points from the verdict, among them the fact that the constitutive session of April 15 and its continuations were declared unconstitutional, due to the interference of Speaker Avni Dehari and manipulations with the agenda. According to Matoshi, this procedural masquerade has violated the constitutional rights of the deputies and has led to a boycott by the opposition.
In another essential point of the judgment, it is emphasized that the largest parliamentary party has the obligation to reach 61 votes with a political agreement.
"Raison d'État – the state before the party – falls on the winning party of the elections," Matoshi wrote.
He adds that although the Constitution provides for a 30-day deadline for the constitution of the Assembly, the Court has no mechanisms to enforce political ethics and cooperation, which, according to him, VV is misusing as a blocking mechanism.
In conclusion, Matoshi sees this situation as a deep institutional crisis with no real solution, saying that:
"The Constitutional Court has not provided a solution to the institutional crisis, but has given Albin Kurti a month to form a coalition."
Finally, he closes the analysis with a powerful phrase, which according to him summarizes the entire situation:
"Compromise, this is the 'Sword of Damocles' hanging over Kurti's neck. He doesn't know it!!!"
