Yesterday, the Electoral Complaints and Appeals Panel (ECAP) made several important decisions regarding the election process of December 28, 2025. The ECAP approved the appeal of the Serbian List, with which this political entity had opposed the decision of the Central Election Commission (CEC) for the non-certification of the final results for its candidates for deputies.
In its reasoning published yesterday, the ECAP assessed that the CEC had not provided a legal basis for refusing to certify the result for the Serbian List. According to the panel of judges, the CEC's decision was deficient, incomplete and did not address the essential issues, nor the decisive facts related to the fulfillment of the legal conditions for the announcement of the final results.
"The CEC decision does not contain proper legal reasoning and does not provide a proper assessment of the facts in relation to the Law on General Elections and Regulation No. 13/2024 on election results," states the ECAP decision published yesterday.
Based on this assessment, the ECAP decided to reverse the CEC decision and announce the final result for the Serbian List and its candidates, emphasizing that this decision guarantees respect for legal procedures and a fair and equal process for the political entity that, according to the ECAP, has met the legal conditions.
Yesterday's decision by the ECAP comes after strong international reactions that were prompted by the non-certification of the Serbian List. Following the reaction of the United States a day earlier, the European Union and international organizations such as the OSCE also expressed concern regarding this issue.
Also yesterday, CEC member from the Vetëvendosje Movement, Alban Krasniqi, expressed dissatisfaction with the ECAP's decision, during his appearance on the "60 Minutes" show on KTV.
Meanwhile, the ECAP rejected a total of six other complaints yesterday, including the complaint of PDK MP Bekim Haxhiu, which concerned around 23 thousand packages of ballots received from abroad, as well as the complaints of three political entities of non-majority communities: NDS, PAI-PDAK-LPB and the United Roma Party of Kosovo.
Following yesterday's ECAP decisions, the parties have the right to appeal to the Supreme Court. Only if the Supreme Court rejects these appeals will the way be opened for the final certification of the results of the early parliamentary elections held on December 28, 2025.
