The Basic Prosecution Office in Gjakova has filed an indictment against ZM for abuse of official position or authority.
He is suspected of not having initiated disciplinary proceedings against Xh.Z., a statistics operator, who did not go to work for four years, while in his position as director of the administration department at the Gjakova Hospital.
According to the indictment, among other things, it is stated that the defendant with the initials ZM, from January 2019 to the end of 2023 in the capacity of an official person, using his official position or authority, intentionally did not fulfill his duties as Director of the Department of Administration and Auxiliary Services at the General Hospital "Isa Grezda" in Gjakova, in order to obtain material benefit from another person - the employee Xh.Z., in such a way that the same, in violation of Article 48, paragraph 2 of Law No. 06/L-114 on Public Officials, as a supervisor and competent authority, even though he had been previously notified by the ZO, about the employee's absence from work, the same did not initiate disciplinary proceedings based on concrete and proven facts for the violation of obligations by the employee Xh.Z., employed at the Hospital in the position of Statistics Operator, enabling the same to receive the total gross salary of €21,473.42 without reporting to work for the period 2019-2023, which caused material damage to the Kosovo budget.
With these actions, he committed the criminal offense of Abuse of Official Position or Authority under Article 414, paragraph 2, in conjunction with paragraph 1 of the Criminal Code.
The prosecutor in the case, upon filing the indictment, proposed to the court that the defendant be found guilty and sentenced according to the law for the criminal offense he is charged with, as well as to impose an additional punishment - Prohibition from exercising functions in public administration or public service.
