PDK MP, Përparim Gruda, in his speech in the Kosovo Assembly where the first reading of the Draft Law on the Bureau for the Confiscation of Unjustified Assets is taking place, listed some of the remarks he had regarding the Draft Law, writes Gazeta Express.
Gruda said that the first mistake was the fact that there was no public consultation. He said that he proposed to the Minister of Justice, Donika Gërvalla, to have a public legislative consultation between the second and third readings.
"There was no public consultation, it should have been put to public consultation before approval by the Government. Such a sensitive law should be subject to a debate by professionals. Every citizen should have been given the opportunity to give their opinion on this law. It is a standard that is required. It was a omission that should not have happened," said Gruda.
"We can organize a public consultation on legislation between the two readings, I have also proposed it to the minister. I think it is the way to make the law in accordance with the Constitution," Gruda continued.
He said that leaving some issues to be regulated by sub-legal acts is still problematic, since the Constitution has clarified that everything must be regulated by law.
"Second remark. The Constitutional Court has made a remark about the law that nothing can be regulated by sub-legal acts, but by law. That provision that is left to the director for actions with some sub-legal acts should be deleted," Gruda said, Express reports.
The PDK MP also spoke about the lack of a compensation mechanism, saying that such a mechanism is necessary to make the Bureau more efficient. According to Gruda, the compensation should be higher, so that the Bureau does not handle just any case.
"The lack of an efficient compensation mechanism. This mechanism makes the bureau more efficient, so as not to deal with just any case," he continued.
Gruda said that the Draft Law also has problems in the way it was written, saying that it was not written in legal language.
"The law is not written in legal language," Gruda continued.
He also criticized the name of the Draft Law, saying that it is not reflected in the content, since the Bureau does not confiscate property, but the Court.

He said that today PDK will abstain from the first reading, in order to create space to have legislative consultations between readings to address the remarks.
Gruda said that if those changes do not happen, PDK will not support such a law.
